`In Platao in the myth of the caves we have the image of those who are in the cave under the shadows and the men who live on top of them, which are erroneous images of reality.`Platao about 400 BC.
I believe that this is the moment to bring our leftovers into the civil and democratic reality in a broad state of law and social justice under the light of the Constitution.
As for Thomas Hobbes in Leviathan, the form and origin of the state, p.223 the thinkers, Chapter XXVII of Crimes,
"A sin is not only a transgression of the law, but also any manifestation of contempt by the Lawgiver"
It is a crime and a sin which consists in committing (by deed or word) an act which the law forbids, or in omitting an act which it commands. Thus every crime is a sin, but not every sin is a crime. But before something done or said appears, where a human judge can discover the intention. You can not talk about crime. Discourse already made by the Greeks in the words Hamartema, Enklema and Aitia, of which the first which translates as sin meant any kind of violation of the law, and the last two which translate as crime, meant only the sin from which one man may accuse another . There is no room for human accusation of intentions that are never made visible in external actions. Similarly, the Latins with the word "pallam" (peccary) designated all kinds of deviations from the law, and with the word "crimes" (derived cerno, which meant "peceber") designated only the sins that may be presented before a judge, and therefore are not mere intentions (Thomas Hobbes).
It is necessary to record that the reality finding both in the myth of the cave (platao) and in the notion of crime (hobbes), is made in the presence of the majority that refers to the Truth in this case Habeas Corpus (Lula), has already been recognized by the testimony of Do Judge Dr. Sergio Moro as well as the 4 federal stick twice. Therefore the notion of reality can be given by the other in Idonea form in the name of Justice and Law. And also the Supreme has previously defined a prison in 2 estancia.
